Privacy Policy for USValidator DApp

Effective Date: September 03, 2025

Ultra Smooth Studio LLC ("Company," "we," "us," or "our"), a limited liability company formed in the State of Florida, United States, operates the USValidator DApp (the "Platform"), available at www.usvdapp.com and through the USValidator mobile app. This Privacy Policy explains how we collect, use, disclose, and protect your information when you access or use the Platform. By using the Platform, you consent to the practices described in this Privacy Policy.

The Platform is a decentralized application built on the Solana blockchain, enabling users to scan QR codes for product authenticity verification, receive rewards in Liquid NFTs (LqNFTs) and $USVT tokens, and interact with blockchain services. Due to the nature of blockchain technology, certain data (e.g., wallet addresses and transactions) is publicly visible on the blockchain and not controlled by us.

If you have questions about this Privacy Policy, please contact us at connect@usvdapp.com.

1. Information We Collect

We collect limited information to provide and improve the Platform's services. The types of information may include:

a. Information You Provide Directly

  • Wallet Information: When you connect your Solana-compatible wallet (e.g., Phantom, Solflare), we may collect your public wallet address to facilitate blockchain interactions, such as verifying scans, issuing rewards, and token conversions. We do not collect or store private keys, seed phrases, or other sensitive wallet credentials.
  • Contact Information: If you contact us via email, phone, or Telegram, we may collect your name, email address, phone number, or other details you provide.
  • Brand Partner Information: If you are a brand partner, we may collect business contact details, product information, and preferences for QR code issuance and analytics.

b. Automatically Collected Information

  • Scan and Usage Data: When you scan QR codes, we may collect data such as the scan timestamp, product details, location (if geolocation is enabled), device type, and interaction metrics. This helps provide real-time analytics to brands and improve the Platform.
  • Device and Log Information: We may collect technical data including IP address, browser type, operating system, app version, and usage patterns (e.g., pages viewed, time spent) through cookies, web beacons, or similar technologies.
  • Blockchain Data: Interactions with smart contracts (e.g., staking $USVT, converting LqNFTs) generate on-chain data, which is publicly accessible on the Solana blockchain. This may include transaction hashes, wallet addresses, and token amounts.

We do not collect sensitive personal information such as financial account details, health data, or biometric information unless voluntarily provided.

c. Information from Third Parties

  • We may receive data from third-party services, such as Solana blockchain explorers, decentralized exchanges (e.g., Raydium, Jupiter), or analytics providers, to enhance functionality.

2. How We Use Your Information

We use the collected information for the following purposes:

  • To provide and maintain the Platform, including processing scans, issuing rewards, and facilitating blockchain transactions.
  • To offer real-time analytics to brand partners, such as scan behavior, locations, and product interactions, in an aggregated and anonymized form where possible.
  • To improve the Platform, detect and prevent fraud, and ensure security (e.g., monitoring for abusive scans or exploits).
  • To communicate with you, respond to inquiries, and send updates about the Platform or rewards.
  • To comply with legal obligations, enforce our Terms of Use, and protect our rights.
  • For internal analytics and research, including under the Self-Expanding Market Cap (SEMC) protocol for $USVT tokenomics.

We do not use your information for automated decision-making that produces legal effects or similarly significant impacts.

3. How We Share Your Information

We may share your information in the following ways:

  • With Service Providers: We engage third-party vendors (e.g., cloud hosting, analytics tools) to support operations. These providers are contractually obligated to protect your data and use it only for the services they provide.
  • Blockchain and Public Disclosures: On-chain data (e.g., wallet addresses, transactions) is inherently public and shared across the Solana network. We do not control this data once it's on the blockchain.
  • Brand Partners: Aggregated scan data (e.g., anonymized location trends) may be shared with participating brands for loyalty programs and anti-counterfeiting efforts.
  • Legal Requirements: We may disclose information if required by law, subpoena, or to protect against harm, fraud, or legal claims.
  • Business Transfers: In the event of a merger, acquisition, or asset sale, your information may be transferred as part of the transaction.

We do not sell your personal information to third parties for marketing purposes.

4. Cookies and Tracking Technologies

The Platform may use cookies, local storage, and similar technologies to enhance user experience, remember preferences, and analyze usage. You can manage cookie preferences through your browser settings, but disabling them may limit functionality. We do not use third-party advertising trackers.

5. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your information, such as encryption for data in transit and secure servers. However, no system is completely secure, especially in blockchain environments where public data is immutable. You are responsible for securing your wallet and devices.

In the event of a data breach, we will notify affected users as required by law.

6. Data Retention

We retain information for as long as necessary to fulfill the purposes outlined in this Policy, comply with legal obligations, or resolve disputes. On-chain data persists indefinitely on the blockchain. You may request deletion of off-chain data (e.g., contact details) where feasible.

7. Your Rights and Choices

Depending on your location, you may have rights under applicable privacy laws (e.g., CCPA for California residents):

  • Access and Correction: Request access to or correction of your personal information.
  • Deletion: Request deletion of certain data, subject to exceptions.
  • Opt-Out: Opt out of data sharing or targeted advertising (though we do not engage in these).
  • Non-Discrimination: We will not discriminate against you for exercising your rights.

To exercise these rights, contact us at connect@usvdapp.com. We may verify your identity before responding. For blockchain data, deletion is not possible due to its immutable nature.

8. International Data Transfers

The Platform is operated from the United States. By using it, you consent to the transfer, storage, and processing of your information in the US, which may have different data protection laws than your jurisdiction.

9. Children's Privacy

The Platform is not intended for children under 13 (or 16 in certain jurisdictions). We do not knowingly collect information from children. If we learn of such collection, we will delete it promptly.

10. Changes to This Privacy Policy

We may update this Policy periodically. Changes will be posted on the Platform with the updated effective date. Your continued use constitutes acceptance of the revised Policy.
